Wisual AI - Terms of Service

1. Use of the Service

Wisual AI allows users to upload property photos and generate AI-enhanced images for marketing and presentation purposes. You are responsible for ensuring that you have the rights to any photos or materials you upload.

Generated images are for visualization and marketing purposes only and should not be treated as architectural, factual, or exact representations of a property. You agree to use the Service only in compliance with applicable law and these Terms.

2. Accounts

To use certain features, you must create an account and provide accurate information. You are responsible for maintaining the security of your account credentials and for all activity under your account.

We reserve the right to suspend or terminate accounts that misuse the Service or violate these Terms.

3. Payments and Credits

Wisual AI offers subscription and credit-based plans. Each generation of images deducts credits according to your plan. Credits may roll over as described on our pricing page. Subscriptions renew automatically unless canceled before the next billing cycle.

Payments are securely processed through Stripe.

Except as required by law, all payments are non-refundable once the payment has been processed.

4. Ownership and Content

You retain ownership of the original photos and materials you upload. Wisual AI retains ownership of all software, algorithms, and AI systems used to create outputs.

The generated images ("AI Outputs") belong to you for marketing and promotional use, but we may use anonymized or non-identifiable versions of generated images to improve our services or for marketing demonstrations.

AI-generated outputs may not be unique across users and should not be claimed as human-created designs.

5. Watermarks and Free Use

Images generated under a free plan include a visible Wisual AI watermark. These images may be used for personal, commercial, and promotional purposes, including publication, marketing, or resale, as long as the watermark remains fully visible and unaltered.

You are not permitted to remove, crop out, or obscure the Wisual AI watermark in any way. Only users on paid plans or credit-based generations may download images without a watermark.

Wisual AI retains ownership of all watermarked images and reserves the right to revoke usage rights if the watermark is modified, removed, or hidden.

6. Prohibited Use

You agree not to:

• Upload copyrighted or illegal material without permission.
• Generate or distribute violent, hateful, explicit, or misleading content.
• Use the Service for fraudulent or unlawful purposes.
• Remove or modify any copyright or watermark notices.

We may suspend or terminate any account found violating these conditions.

7. Limitation of Liability

The Service and all generated content are provided "as is." Wisual AI is not liable for indirect, incidental, or consequential damages, including loss of data, revenue, or goodwill.

We do not guarantee that generated outputs will be accurate, unique, or free from errors.

8. Privacy and Data

We respect your privacy. Personal data is collected and processed according to our Privacy Policy, in compliance with the EU General Data Protection Regulation (GDPR).

All user data is securely stored within the European Union.

9. Governing Law

These Terms are governed by Danish law.

Any disputes arising from these Terms shall be resolved by the courts of Denmark.
